What You Should Know About Auto Accidents and Insurance Companies
Dealing with the insurance adjuster assigned to a bodily injury claim is never easy. Retaining the best personal injury attorney in Modesto can make a difference in not only increasing the chances of obtaining the fair compensation you deserve but taking the stress out of the situation. An injury lawyer can handle all aspects of your case to allow you to focus on recovering from your injuries.
When you decide to represent yourself after a car accident, you should expect to experience some defense tactics an insurance adjuster may use to downplay the value of your claim or deny it altogether. This may include shifting fault as a way of asserting you as responsible for the incident, disputing medical expenses as unrelated to the crash or excessive in nature, and insisting on a recorded statement to move forward with a personal injury claim.
Keep in mind that an insurance adjuster is trained to evaluate claims and pay as little as possible. This is the way of the insurance company protecting its bottom line. The truth is that the insurer will not have your best interests at heart like an experienced personal injury lawyer will. That is why it is best to work with an attorney to ensure you receive a fair settlement for your injuries and damages incurred.
Compensation in a Bodily Injury Claim for a Modesto Traffic Collision
People injured in motor vehicle collisions may seek recovery of losses incurred which may include economic and non-economic damages. Economic damages in a personal injury case represent financial losses that include medical bills, lost wages, and out of pocket expenses related to the accident. Non-economic damages, on the other hand, consider intangible losses like loss of enjoyment of life, disfigurement, and pain and suffering.
Aside from economic and non-economic damages, punitive damages are much more challenging to recover in California. The reason being that it must be proven in court that the at-fault party acted egregiously, such as excessive speeding or driving under the influence of alcohol or drugs (DUI). They are not covered by insurance and are sought from the negligent party directly as a way of punishing them for their wrongdoing. Calling an experienced attorney is an essential step to protect your rights as a claimant. For details on how to find the best lawyer in your area to handle your case, watch the video below.
Benefits of Working with a Personal Injury Attorney
Working with an experienced injury lawyer is critical for obtaining fair compensation. An attorney can help by:
- Conducting an independent investigation of the traffic collision to identify which party or parties may be responsible for the incident
- Collecting and preserving critical evidence for the bodily injury claim to prove the full extent of injuries and losses incurred
- Handling communications and negotiations with the insurance company on the client’s behalf
- Identifying other potential sources of recovery such as uninsured/underinsured motorist coverage (UM/UIM) if the at-fault party has minimal bodily injury liability coverage or none at all
- Ensuring all filing criteria and deadlines related to the motor vehicle accident claim are met
- Working with expert witnesses to prove the full extent of economic and non-economic damages incurred
- Preparing a strong case for personal injury compensation and presenting it in court, if necessary
