Injury Claims Process for a Car Accident

Due to the severity of a rollover accident, an injured individual may face mounting medical expenses, time away from work, and months or even years of painful physical recovery. It is only right that the at-fault party and their insurance company pay the financial compensation an injured person needs to get through this challenging time. However, not all insurance carriers have the best interests of people injured by their insured’s negligence. Insurance companies are in the business of paying as little as possible on personal injury claims as a way of protecting their bottom line. A Stockton car accident lawyer will work to ensure that their client receives everything they need from the negligent driver’s insurer, including all the personal injury damages that they have faced to date and will most likely suffer in the future. Other Parties Responsible for a Rollover Accident

A few parties, other than the driver who caused the crash, might be deemed at-fault for a rollover accident. This includes automakers for vehicle defects and government entities for roadways in poor conditions. A car manufacturer may be held responsible for their negligence if the roof of their vehicle involved in the rollover failed to meet Federal Motor Vehicle Safety Standard 216, which oversees roof crush resistance. In the United States, automakers are expected to design and manufacture cars with roofs that can maintain its structural integrity in a rollover. Under this standard, the roof of a vehicle must withstand at least 1.5 times the unloaded weight of the vehicle. If the car manufacturer fails to meet this standard, it may be held financially responsible for any injuries or death that occurred as a result. To seek financial compensation from an automobile manufacturer through an auto products liability claim, the vehicle in question must be kept and preserved until it has been examined by an experienced injury lawyer. An attorney and their team of experts can best determine whether a defect in the roof of the vehicle exacerbated any injuries or deaths in the rollover accident.
