What is a Wrongful Death Claim?

To account for emotional and financial burdens, there are measures put in place to hold parties accountable for fatal accidents. Under California law, eligible surviving family members may bring a claim for wrongful death against the individual or entity whose negligence or carelessness led to an incident that claimed a loved one’s life. These cases are intended to seek reimbursement for non-economic and economic damages. The purpose of damages is to offset the intangible harm and financial hardship that has occurred due to the sudden loss of life.

Survivors who are eligible to file under California law may seek compensation for losses, such as wage loss of the deceased individual, funeral and burial service costs, expenses for end-of-life treatment (recoverable through a survival action), loss of care, affection, and companionship, mental anguish, and other associated losses. If the at-fault party’s actions were particularly egregious, it may be possible for surviving family members to seek punitive damages. A case that may warrant punitive damages may include one that involves DUI or excessive speeding on the part of the at-fault party.

Surviving family members deserve justice and financial compensation to start the healing process. Retaining legal counsel may be greatly beneficial to the recovery process. Who is Eligible to File a Case of Wrongful Death in California?

To file a wrongful death claim in California, you must be an eligible party that meets the criteria set forth in CCP 377.60. This sets priority for specific family members, including children, spouses, and domestic partners. If there is no surviving domestic partner, child, or spouse, family members who were financially dependent on the deceased individual may be next in line to file a case of wrongful death. It is essential that survivors speak with a knowledgeable lawyer with the experience, knowledge, and resources to handle their case.

There are strict filing deadlines in cases of wrongful death. This is established in CCP 335.1. Most cases must be filed within two years of the date of loss. Failure to protect the statute may result in the court dismissing the matter. As such, surviving family members should get in touch with an experienced attorney to ensure that the necessary documentation and time limits are met in their case.
