What to Expect From an Injury Case for a Bicycle Accident

Drivers are generally the at-fault party in a vehicle versus bicycle collision. However, other parties may be involved or responsible as well. For instance, if a faulty bike part contributed to an accident, the manufacturer may be held liable for the damages. Conversely, if dangerous road conditions were involved in a cycling crash, the government entity responsible for the design and maintenance of the roadway may be held liable. An investigation into a bicycle accident is necessary to establish liability on the other side’s part and damages that occurred as a result of the incident and reported injuries.

Determining the cause of a bicycle accident is essential in recovering compensation for the losses and injuries sustained. Some of the common reasons for cycling crashes include drunk driving, speeding, distracted driving, failure to obey traffic lights and stop signs, failure to yield the right-of-way to cyclists, unsafe lane changes, and more. Evidence that should be collected in support of a bodily injury claim for a bicycle collision includes police reports, medical records, statements from eyewitnesses, photos of the crash site and visible injuries, etc.

Proving liability in a bicycle accident may be challenging if the motorist disputes liability for the collision or fled the scene of the crash. Should You Accept the First Settlement Offer From the Insurance Company?

When dealing with insurers, including your own, it is crucial to understand that the insurance company’s goal is to protect profit margins. In other words, insurance carriers are not concerned with providing the compensation injured parties need to recover from accident-related injuries and losses. Keep this in mind following a cycling crash. It is best to retain legal counsel immediately to protect your rights and best interests. Above all, remember that the first settlement offer from the insurer will be far less than what you deserve, and your attorney will stop at nothing to obtain the full compensation you need.
