Seeking Financial Recovery in Traffic Collision Cases

A car crash has the potential to cause many types of injuries. These may include concussions, ruptured disks, traumatic brain injuries, broken bones, internal trauma, and more. In some extreme cases of traffic collisions, death may occur. If someone else is to blame for the traffic wreck, an injured party or surviving close relative may hold the other side accountable. This generally requires filing a claim for damages against the negligent party. Such cases are usually subject to a maximum of two years. If the case is not filed or settled, and the statute of limitations runs out, the claimant may lose the right to seek damages.

Each personal injury case and its value is different because of the unique facts and circumstances involved. As such, a California personal injury attorney will work diligently to investigate crashes, get to know their clients and transform economic and non-economic damages into quantifiable amounts. Many factors are involved in calculating the reasonable and fair value of compensatory damages. Considerations for valuing injury cases include the severity of crash-related injuries, costs of treatment, costs of home modifications, diminished quality of life, wage loss, and more.

Recovering compensation in a traffic collision generally involves filing a claim for damages against the negligent motorist. If the at-fault driver fled the scene and goes unidentified, an injured party may be eligible for seeking damages through their uninsured motorist coverage. It is recommended that parties injured in hit-and-run accidents retain legal counsel. Their attorney will hire a private investigator who can work to identify the fleeing motorist.
