Things to Know About Hit-and-Run Pedestrian Accidents

Walking is a way of life and a mode of transportation in California. However, the golden state sees a high rate of fatal pedestrian accidents annually. According to the California Office of Traffic Safety, 893 fatalities were reported in car vs. pedestrian crashes in 2018, the year with the most recent data available. With this information in mind, it is essential that drivers and pedestrians take precautions when sharing the road. While drivers owe a duty of care to pedestrians on the road, they owe a greater duty to children. Regardless of the circumstances, a motorist must exercise additional due care when driving in areas where children are present. This may include parks, residential areas, school zones, and shopping centers.

Negligent drivers and their insurance companies have a responsibility to pay for the losses resulting from a pedestrian accident they caused. An injured pedestrian may have a claim for financial recovery under the other side’s insurance policy so long as there is clear evidence demonstrating negligence on the part of the involved driver. Evidence may include police reports, medical records that link the incident and reported injuries, statements from eyewitnesses, and expert witness testimony.

If the at-fault party does not have liability coverage or carries minimal bodily injury liability limits, an injured pedestrian may have recourse through their uninsured and underinsured motorist protection. If the injured party does not have auto insurance, but a member in their household does and has UM/UIM coverage, they may have a claim so long as they are not excluded from the plan. What is useful about UM coverage is that it may pay for losses up to the plan’s limits for a hit-and-run accident, even if the suspect party is not located.
