What to Expect from the Claims Process for a Car Accident

A car wreck may result in significant consequences for all parties involved. The economic and non-economic damages related to a motor vehicle collision may be recovered through a claim filed with the insurance company representing the negligent driver. These are intended to make a claimant whole again. Bringing a claim on your own may be time-consuming and overwhelming, especially when difficult insurers are involved. That is because insurance carriers are focused on protecting profit margins.

One of the ways that an insurance company may accomplish that is by making a quick settlement offer to the injured party. Keep in mind that the first settlement offer will often be far less than what is needed to cover medical bills for ongoing and future treatment, wage loss, and more. The same may be said for a wrongful death claim brought on behalf of surviving family members seeking reimbursement for funeral service costs, medical bills, loss of companionship, and other losses.

Given that the losses are often significant in head-on collisions, it may be challenging to navigate the recovery process when the at-fault party has limited or no liability insurance. Fortunately, there may be recourse if you have UM and UIM coverage under your insurance policy. Such claims can be complex because of the requirements that must be met. Is There a Deadline for Filing a Car Accident Case?

There is a two-year statute of limitations that generally applies to personal injury lawsuits. If the case is filed in civil court after the deadline has passed, it may be dismissed by the court, and the claimant may lose the right to seek damages. The same statute of limitations also applies to wrongful death matters.

There are also some exceptions that should be noted in these cases. That is because a notice of claim must be provided to a public agency within 180 days of the incident date if the accident involved a government vehicle or road defect. Given that each accident case is unique, it is recommended to learn about your rights and options for recovery by consulting with a skilled attorney.
