Importance of Evidence in an Auto Accident Injury Case

When a negligent or careless driver causes a traffic accident, the injured party may seek reimbursement through a claim for damages. The injured individual must file a personal injury claim against the at-fault party and their insurer. In the case that the motorist who caused the crash has insufficient coverage or no car insurance, the injured party may have to file a claim through their uninsured and underinsured motorist protection. It is useful to have UM and UIM coverage in California, where there is a high rate of uninsured drivers at 16.6 percent, according to a report by the Insurance Information Institute.

Eligible claimants may seek reimbursement for losses associated with the car wreck. This may include the costs of reasonable and necessary treatment of crash-related injuries, wage loss, pain and suffering, etc. Conversely, if the motorist who caused the crash engaged in egregious conduct in the moments leading to the incident, an injured party may seek punitive damages. Building a strong case for full compensation requires providing as much relevant information as possible. That is generally accomplished through compelling evidence and documentation demonstrating causation and damages.

Evidence may include the traffic incident report by law enforcement that determined the other party was responsible for the incident, a physician’s medical assessment of crash-related injuries, a complete list of damages to date and anticipated losses, like diminished earning potential and future medical treatment that is reasonable and necessary. Clear and compelling documentation of non-economic and economic damages is essential. Otherwise, the insurer is likely to dispute a claim or outright deny it. That is why it is recommended to retain legal counsel in cases of personal injury.
