What to Expect From a Car Accident Case

An independent investigation of a car accident may have a significant impact on the outcome of a personal injury or wrongful death case. This is especially true when liability for the incident is disputed. As such, it is recommended to retain legal counsel with the resources to conduct an in-depth investigation into an auto wreck to identify all at-fault parties and properly establish fault. An attorney will review, gather, and preserve evidence that is necessary for demonstrating causation and the extent of damages incurred in an accident case to prepare for negotiations with insurers and defense counsel.

Dealing with insurance carriers after a traffic collision may be frustrating, especially when insurers delay, devalue, or deny claims for damages resulting from crashes. While each situation is unique, insurance companies often make the recovery process challenging for claimants. Insurance carriers often delay claims to provide claimants less time to file a lawsuit and the statute of limitations expiring. Insurers may dispute or deny claims on the basis of pre-existing conditions, liability for the crash, etc. These all serve as defense tactics to limit an insurer’s financial liability and protect profit margins.

Is There a Time Limit on Accident Cases in California?

The statute of limitations sets a time limit within which a case must be filed. If a case for personal injury or wrongful death is not filed within the specified deadline, the right to seek damages may be lost as the matter may be dismissed by the court. Most cases have a time frame of two years. It is essential to note that some exceptions may apply. To ensure that the statute of limitations is protected in your case, it is crucial to retain legal counsel right away.
