Recoverable Damages in Wrongful Death Cases
In California, wrongful death claims are legal actions brought by the surviving family members of a deceased person whose death was caused by the negligent, reckless, or intentional actions of another party. The law allows immediate family members, typically the surviving spouse or partner, and children, to seek financial compensation for their devastating loss. If no direct heirs exist, others who depended financially on the deceased, such as parents or stepchildren, may also be eligible to file a claim.
The compensation sought in a wrongful death claim can cover multiple damages. Though no amount of compensation can truly substitute for the loss of a loved one, these claims provide a means for families to alleviate financial burdens and seek a sense of justice. Recoverable compensation usually includes the following:
- Expenses related to funeral and burial services can be reimbursed.
- Claimants may recover the deceased’s projected future earnings, including wages, pensions, and insurance benefits, until the estimated retirement age.
- Families can pursue damages for the loss of emotional support, guidance, and protection following their loved one’s passing.
- Spouses have the right to seek compensation for the loss of companionship and marital support.
- Compensation for the loss of anticipated future household contributions from the deceased can be claimed.
