Details on the DUI Crash in Rural Stanislaus County That Left Four Injured

CHP traffic officers indicated that the incident involved a Kia Forte and a big rig. Officials were informed by witnesses that the Kia driver allegedly ran the stop sign and collided with the semi-truck at the intersection. The impact of the collision propelled the large truck into a tree and fence of a nearby property while the Kia struck a wooden pole. The big rig driver, a 23-year-old man, sustained injuries described as minor with pain to the knee, back, and head. It was unclear whether he was hospitalized for his injuries.

The Kia driver suffered a neck injury from the crash, according to authorities. Two of the three passengers of the Kia were said to have suffered serious injuries. One of the passengers, a 21-year-old Modesto resident, was taken via air ambulance to Doctors Medical Center in Modesto for treatment of a broken arm and rib fracture. They were last reported in critical condition. The second passenger, a 21-year-old Turlock resident, sustained a femur fracture. The third passenger, a 16-year-old Turlock girl, suffered facial lacerations from the crash.

Officials reported that the Kia driver, a 23-year-old Modesto woman, was arrested on suspicion of driving under the influence of alcohol. Authorities also indicated that her driver’s license was also suspended for a previous DUI. Additional information on the truck accident in rural Stanislaus County, including an update regarding the conditions of those injured, was not immediately available.

Things to Know About Traffic Collisions and Personal Injury Claims

After a motor vehicle accident, it may take weeks, months, or even years to get your life back on track. Such situations may place injured parties in a financial predicament, particularly when traumatic injuries are involved. Medical expenses may mount quickly, and if injuries have temporarily or permanently placed an individual out of work, a sudden loss of earnings may result in difficulty in making ends meet. Fortunately, California law recognizes the hardship that may accompany an auto accident and allows injured parties a way of seeking financial compensation for their losses through a bodily injury claim if the incident was the result of another party or entity’s negligence.

The primary recourse for financial recovery usually lies with the insurance company representing the at-fault party. A claimant may be able to recover economic and non-economic damages such as medical expenses, lost income, pain and suffering, and other accident-related losses. If the negligent driver was charged with DUI in connection with the crash, punitive damages may also be sought from the at-fault party. This type of damage is generally awarded at the discretion of the court as a way of punishing the other party. Conversely, an injured party may claim against their own insurer if they have uninsured and underinsured motorist coverage. This type of protection may pay for damages if the at-fault party carries insufficient or no bodily injury liability coverage. Such cases are also subject to strict filing criteria and deadlines.

When a party has suffered injuries in a crash caused by someone else’s negligent or reckless actions, it is essential to reach out to an experienced injury lawyer. An attorney with years of experience handling personal injury claims will have the expertise and knowledge to ensure that the injured party is fairly compensated for the harm and losses they have endured. Since insurance companies are focused on protecting their bottom line, it is not uncommon for the insurer to pressure the claimant into accepting a low ball settlement offer. Therefore, it is essential to retain legal counsel to avoid the possibility of the insurance carrier attempting to take advantage of you and your vulnerable situation.
