Types of Recoverable Losses in an Auto Accident Injury Case

Injuries from a traffic collision may be serious and even fatal in some cases. Traumatic injuries may often require the need for extensive medical treatment and time missed at work for recovery. Serious injuries may require a lifetime of ongoing treatment and renovations to the injured party’s home and vehicle to accommodate permanent injury or disability caused by the crash. In addition to crash-related injuries, many individuals may experience mental anguish and emotional distress due to a motor vehicle collision that may prevent them from living a normal life.

If a multi-vehicle accident was the result of another motorist’s negligence or carelessness, those injured in the incident may be entitled to financial recovery of their wage loss, medical bills, pain and suffering, and other losses associated with accident-related injuries. The process will involve filing a claim for bodily injury against the negligent driver. Given that there may be several injured parties in a multi-car crash, there may be concerns regarding coverage. Fortunately, injured parties can turn to their uninsured and underinsured motorist coverage for protection and peace of mind in these situations.

What Must Be Proven in a Case of Personal Injury?

Bringing a successful personal injury case forward requires meeting all the necessary criteria and elements. As such, the burden falls on the injured party to prove that they were owed a duty of care from the negligent party, the defendant breached the duty of care, the breach was the direct cause of the incident, and the injured individual suffered damages or harm as a result. Once a lawyer proves all elements, they will seek damages for their client. This will be based on the long-term consequences of the specific injury sustained in the incident.
