What You Should Know About Head-On Collisions and Personal Injury Claims

A head-on collision has the potential to result in some of the most devastating injuries on the spectrum. This is because of the immense physical impact of the crash from vehicles traveling in opposite directions and colliding with one another. Some of the potential causes of such accidents may include drivers entering the oncoming traffic lane due to overtaking other cars, fatigue, intoxication, and a wide array of other factors.

Establishing liability in a motor vehicle collision is necessary for an insurance claim. The determination of fault will depend on the evidence at the scene, such as the point of impact and the area in which the point of impact occurred. To prove negligence, an attorney may examine the scene, evidence, traffic incident reports, accident-related medical records, and work with accident reconstruction experts.

If you have been hurt in a crash caused by another driver or entity, you may be entitled to financial compensation for the injuries and damages that have been caused. Do not let insurance companies take advantage of you and your vulnerable situation. Our Brentwood personal injury attorneys are here to help you obtain justice and fair compensation.

Types of Compensation in a Personal Injury Claim for a Head-On Collision

The aftermath of a car accident may be challenging in terms of emotional, physical, and financial hardship. Working with an experienced attorney can simplify the personal injury claims process. An attorney may gather, preserve, and present evidence to the insurance company to support the case and damages incurred. This includes medical expenses, lost wages, pain and suffering, and other losses. For information on the types of factors that may impact the value of a personal injury claim, watch the video below.

Aside from personal injury damages, punitive damages are allowed in head-on collision cases in California, where it can be proven that the negligent driver acted in a manner that is considered egregious. Excessive speeding and driving under the influence of alcohol or drugs (DUI) may be grounds for punitive damages in personal injury cases arising from such accidents. Punitive damages are solely intended to punish the at-fault party for their wrongdoing and to serve as a message in the community that this type of behavior will not be tolerated.
