Two Injured After Fiery Big Rig Crash in Madera County

Fiery Truck Crash on Highway 152 in Madera County

Two parties were injured after a fiery truck crash on Highway 152 in Madera County on the early morning of Tuesday, June 23, 2020. The big rig accident occurred around 6:00 a.m. on CA-152 near Road 9. The California Highway Patrol (CHP) reported that a diesel truck hauling garlic was involved in a traffic collision with a Honda. The impact caused both vehicles to veer out of control. The tractor-trailer caught fire, and the trucker escaped the big rig with injuries described as minor. The driver of the Honda suffered a femur fracture, officials said. An ambulance responded to the scene to transport at least one party to Community Regional Medical Center in Fresno for treatment.

Who is Responsible for a Madera County Truck Crash?

Big rig crashes are often more challenging than car wrecks. The injuries may be catastrophic due to the overwhelming size and weight of large commercial trucks. There are often several semi-truck accident claims filed against the insurance company representing the trucker. This makes it particularly crucial to investigate all factors that may have contributed to a tractor-trailer collision. In some personal injury cases, the trucking company, truck manufacturer, or third-party loader may be held financially accountable for an 18-wheeler accident. For instance, it may be appropriate to file a personal injury claim against the trucking firm and their insurance company for negligent hiring if a truck driver was hired regardless of having a background that reveals a driving under the influence (DUI) problem and the trucker causes a DUI crash that causes serious or fatal injuries.

What Damages May Be Recovered for a Truck Accident?

A trucking accident may cause life-threatening injuries to other drivers and their passengers. Not only does excruciating pain come with such injuries, but they also require extensive medical treatment and often result in temporary or permanent disability from returning to work. Fortunately, California allows people injured in truck accidents to recover financial compensation for economic and non-economic damages. These include past and future medical care and bills, lost wages, loss of future earnings, lost enjoyment of life, loss of consortium, property damage, and pain and suffering. The amount of compensation awarded in a personal injury case for a truck accident will vary upon the nature of the accident and the extent of trauma suffered.

What is the Filing Deadline for a Personal Injury Lawsuit in California?

Seeking compensation for a truck accident through a personal injury claim requires strict adherence to filing criteria and procedures. Injury cases in California follow a two-year statute of limitations. This means a personal injury lawsuit must be brought within the deadline, which is two years from the date of a motor vehicle accident to protect the statute. If a case is not filed within the time limit, it may be dismissed by the court, and result in the loss of recovering damages entirely. That is why it is essential to work with an experienced Madera truck accident lawyer who can ensure all filing procedures and criteria are met in your case.
