Fatal Motorcycle Crashes and Wrongful Death Claims

According to California law, a loss of life that occurs through the recklessness or negligence of another party or entity is considered wrongful death. In the case of a fatal motorcycle crash, the loss of life may be due to driver error, the entities responsible for designing and maintaining safe public roadways, or a vehicle manufacturer. In either of these situations, an independent investigation into the fatal incident is necessary to properly establish fault. It is essential to collect evidence before it is destroyed or lost. Without evidence, it may be challenging to prove negligence and demonstrate the resulting damages.

The wrongful death claims process may be challenging for surviving family members to navigate without legal counsel. Survivors have enough on their plates to deal with as they are dealing with grief. All too often, insurance companies often attempt to take advantage of the decedent’s family in their time of loss. Insurers are not concerned with the mental anguish and emotional pain that surviving family members have endured because of their loss. Insurance carriers are focused on settling claims for the lowest amounts possible.

For this reason, it is crucial that surviving family members secure the services of a skilled California wrongful death lawyer before dealing with insurers. Having an experienced and knowledgeable attorney on your side is crucial to protecting your rights. Unlike insurers, a lawyer will work hard to secure the full compensation survivors need to move forward with their lives. Is There a Deadline on Wrongful Death Cases?

Remember that California imposes a statute of limitations, or filing deadline, on wrongful death cases. This means that survivors have a limited amount of time to file a lawsuit in civil court if they have not yet settled with the defendants and insurance companies. Failure to file within the deadline may result in the loss of the right to seek financial compensation and the loss of the opportunity to hold the other side accountable for your loss. By retaining legal counsel, you can rest assured that all aspects of your case will be handled appropriately.
