What is a Wrongful Death Claim and How Can it Help Our Family?

An accident claiming the life of a loved one may be immeasurably painful and devastating for the family left behind to pick up the pieces. Filing a wrongful death claim may seem stressful and overwhelming on top of the grief that comes with losing a family member. However, it is essential for survivors to consider, given that it may hold the other side accountable for their actions. While compensation from the case cannot replace the life that was lost, it is a form of justice and may provide surviving family members with the sense of closure they deserve. Bringing a wrongful death case against a negligent party for the resulting damages may also benefit survivors by preventing others from going through the same harm.

There is a time limit for claiming wrongful death in California. This is referred to as the statute of limitations which is usually two years from the date of a fatal accident. In other words, a family has up to two years from the date of an incident that claimed a loved one’s life to file a wrongful death case in civil court. However, there are some exceptions, such as those that involve a government agency. The deadline may be lowered to 180 days or six months per California Government Code Section 911.2. Therefore, it is best to consult an experienced accident attorney to advise you on notice requirements.

In a wrongful death case, the family must prove that the other side’s actions caused the loss of life. Four elements must be established, including duty of care, breach of duty of care, causation, and damages. These are proven through clear and compelling evidence. In the case of a hit-and-run accident, it may be challenging to prove wrongful death without the suspect driver or vehicle. With the assistance of a San Leandro wrongful death attorney, they will use their resources to work with a private investigator to track down the suspect party if authorities are unsuccessful in doing so. A lawyer will also look into other sources of financial recovery, such as uninsured motorist coverage, for a fatal hit-and-run case.
