What to Expect from a Wrongful Death Car Accident Case
Losing someone you love in a car accident is heartbreaking and devastating. When that death was the result of another party’s recklessness or negligence, the grief from that loss may be compounded by anger and frustration. In California, a wrongful death action may be filed to recover economic and non-economic damages for the loss of a loved one caused by the carelessness or negligent actions of another party or entity. In the context of a traffic collision, a claim may be filed against the driver responsible for the crash and their insurance company.
California law limits who have priority to file for wrongful death and that generally includes the decedent’s spouse, domestic partner, or children, per CCP 377.60. If the deceased does not have a surviving domestic partner, spouse, or child, other relatives who meet the eligibility criteria may file for wrongful death. Keep in mind that there is a maximum of two years allowed to file a case in civil court. While this may seem like ample time, there is a considerable amount of time and effort that goes into investigating a fatal accident and building a strong case for maximum financial recovery.
The purpose of compensation in a wrongful death claim is to alleviate the financial hardship placed on survivors after the unexpected loss of a loved one. An experienced attorney can help surviving family members seek justice and full financial recovery in their cases. Holding liable parties accountable for their part in a fatal accident may be powerful in preventing similar tragedies from happening again to others in the community.
