What Surviving Family Members Should Expect from the Wrongful Death Claims Process
Nothing is more painful and devastating than never having the right opportunity to say goodbye to a loved one. When a family is deprived of a member due to the negligence of another party or entity, they may seek justice and financial compensation in the form of a wrongful death claim. In a fatal motor vehicle collision, a claim is generally brought against the driver responsible for the crash and their insurance company. Some exceptions may apply, such that the driver having no liability insurance or not enough coverage to pay for the family’s damages. Another avenue of recovery would be through the decedent’s uninsured and underinsured motorist coverage.
Under CCP 377.60, spouses, domestic partners, and children can file a wrongful death case. Other family members who were dependent on the decedent for financial support may be eligible for filing if the deceased was not survived by a spouse, domestic partner, or child. Eligible surviving family members may seek reimbursement for economic and non-economic damages. These may include the costs of burial and funeral services, loss of benefits and income if the decedent made monetary contributions to the family household, loss of companionship, mental anguish endured by survivors, and more.
The wrongful death claims process may be challenging to navigate because of the many deadlines and rules that must be followed.
