What Families Should Know About Wrongful Death Truck Accidents

A fatal motor vehicle crash may devastate surviving family members, potentially leaving them with immense financial hardship and grief. When someone loses their life in a truck accident because of the negligence of a trucker or trucking company, survivors may be entitled to seek financial compensation through a civil case. While bringing a wrongful death claim may be the last thing on the minds of a grieving family in the time following the incident, it is essential to understand your rights as a survivor.

A motor vehicle collision involving a large commercial truck may occur, and sometimes they are unavoidable. To be successful in a wrongful death case, it must be established that the other party owed the decedent a duty of care, a breach occurred because of the at-fault party’s failure to uphold their duty of care, the breach was the direct cause of the fatal incident, and quantifiable damages occurred as a result. Building such cases require substantial time and effort as the insurance company representing the negligent truck driver or trucking company may be unfair when it comes to the claims process. This may make the recovery process even more challenging for survivors to cope with.

When coping with the loss of a loved one following a fatal big rig crash, the last thing anyone would ever want to deal with is difficult insurance companies looking to pay as little as possible on their claim. To ensure you obtain justice on behalf of your loved one and recover fair compensation, it is essential to retain legal counsel with years of experience handling and litigating wrongful death truck accident cases. Unlike the insurance carrier, the attorney will protect the family from unfair claims practices and work hard to ensure they are fairly compensated for the undue harm they have experienced.
