Seeking Financial Compensation and Justice in Wrongful Death Car Crash Cases
Every motorist carries an obligation to adhere to the rules of the road and operate their vehicles safely. This is intended to avoid causing harm to others on the road, including pedestrians, cyclists, motorcycle riders, and drivers. If a catastrophic or fatal motor vehicle collision occurs while the other party is engaged in careless or negligent conduct, the injured party or decedent’s family may have grounds for a claim for damages. Negligence may come in many forms in car accidents, including speeding, not adjusting vehicle speed to road and weather conditions, DUI, distracted driving, and more.
While it is impossible to reserve the loss of a close relative, there are legal options available to survivors. Bringing a wrongful death action against the liable party may assist in recovering some of the financial losses due to the unexpected loss of a loved one. It may also provide a way to hold the opposing party accountable for their actions. Surviving family members must act quickly as they generally have a maximum of two years to file a case against the other side to seek damages. This is by CCP 335.1. Failure to meet this deadline will result in losing the right to recover losses.
California law allows eligible survivors to recover financial compensation in the event of a loved one’s wrongful death. This may include medical expenses from the time the close relative was injured until their demise, final resting arrangements, lost wages and financial benefits the decedent would have earned and provided to the household, mental anguish from the loss of life, loss of companionship experienced by survivors, and more. Filing a case may seem like a lot while coping with grief, but an experienced California wrongful death attorney can simplify the process for survivors.
