Who May Be Liable for a Fatal Single-Vehicle Accident?

While it is often assumed that the driver of the car that was involved in a single-vehicle accident is the one to blame, the reality is that other parties may be held liable for the incident. This may include but is not limited to:

  • Automaker: In the event of a rollover accident, the resistance rating of a vehicle roof is an essential component to preventing the risk of serious injury or death to occupants inside the involved vehicle. When a car fails to meet Federal Motor Vehicle Safety Standard (FMVSS) 216 on roof crush resistance, the automaker can be held liable. This standard outlines the requirements that vehicles must meet to protect consumers from harm’s way. The roof of the vehicle must withstand a force that is at least 1.5 times the car’s weight. When it has been determined through an independent investigation and expert witness testimony that the vehicle fails to uphold this standard, the manufacturer may be held liable for any exacerbation of injuries resulting from a rollover accident. Keep in mind that the vehicle involved in the incident must be kept and preserved for an investigator to evaluate and determine whether negligence on the part of the automaker played a role in the rollover collision.
  • Government Entity: While most car accidents are the result of driver negligence, other contributing factors may be involved. A road defect may also cause a traffic collision and lead to traumatic injuries or even death to drivers and passengers. Roads that present an inherent danger to others may result in government entities that are responsible for the design and maintenance of the roadway becoming potentially liable for any resulting damages. Proving liability in such cases may be challenging without the assistance of an experienced Madera car accident lawyer. Since specific filing criteria and deadlines also apply, such as the six-month statute of limitations outlined in California Government Code Section 911.2., it is essential to retain legal counsel right away to protect your rights and interests.

If you have lost someone you love in a single-vehicle accident and believe that another party or entity is to blame for the incident, it is crucial to discuss your case with an accident attorney that knows what it takes to independently investigate these types of claims.
