What is Recoverable in a Wrongful Death Case?

Wrongful death occurs when an individual loses their life because of someone else’s negligence. There are a wide array of reasons that a person may suffer fatal injuries due to the negligent actions of another party or entity. However, some of the most common include motor vehicle collisions, and pedestrian accidents are no exception. If you lost a family member in a car vs. pedestrian crash, you may be entitled to financial recovery in a wrongful death claim for the non-economic and economic damages you have suffered.

Recoverable losses in a wrongful death case may include costs of funeral and burial services, loss of future earnings the deceased would have provided to the family if not for the fatal incident, mental anguish suffered by survivors, loss of companionship, lost benefits, and more. Expenses for end-of-life medical care may be recovered in a survival action. If the at-fault party does not have liability insurance or has minimal policy limits, surviving family members may have recourse through an uninsured or underinsured motorist claim.

With the assistance of an experienced Atwater wrongful death lawyer, such as ours from AutoAccident.com, it is possible to hold the other liable for the harm their actions have caused. Is There a Time Limitation on Wrongful Death Cases in California?

There is a two-year deadline for most wrongful death lawsuits, per CCP 335.1. However, the time limit is not always clear, given that it may differ based on the circumstances of the case. For instance, if a public agency is listed as a defendant, the deadline is six months for filing a notice of claim. An experienced accident attorney can determine the statute of limitations applicable to your case.
