Loss of a Loved One to Wrongful Death

A wrongful death claim is intended to provide surviving family members with financial compensation for the losses they have suffered because of the sudden loss of a loved one. Death resulting from negligent or reckless actions is devastating, but survivors can obtain a sense of justice by holding the at-fault party financially accountable for their loss.

Our Tracy wrongful death attorneys can help you bring a wrongful death case with compassion and expertise. A wrongful death action is a civil case that helps surviving family members by compensating them for the economic and non-economic damages they have experienced because of their unexpected loss. These may include medical expenses, funeral costs, lost income, loss of future earnings, loss of companionship, care, guidance, and mental anguish. Punitive damages may also be recovered in some wrongful death cases so long as it can be proven that the at-fault party acted egregiously leading up to the fatal accident (e.g., excessive speeding or impaired driving).

Who Can File a Claim for a Tracy Fatal Pedestrian Crash?

The spouse, domestic partner, or children of the deceased individual have priority in filing a wrongful death claim in California. This is by the California Code of Civil Procedure Section 377.60. If there is no relative in this category, parents, stepchildren, putative spouses, or children of the putative spouse may be allowed to file. Such cases must be filed within two years of the fatal incident to protect the statute and prevent the risk of the case being dismissed by the court for missing the deadline.
