How Can a Wrongful Death Claim Help Our Family?

The loss of a close relative is devastating and traumatic, particularly if it occurs suddenly because of another party’s negligence. Financial challenges and mental anguish often follow the death of a loved one. In a wrongful death case, surviving family members may seek economic and non-economic damages from the negligent party who caused their loss. This may include loss of companionship, costs of funeral services, medical bills, lost financial support, and more. While no amount of compensation may undo the tragic event that took place, an experienced Fremont wrongful death attorney can work to ensure that all aspects of your case are handled effectively. This will allow your family the time to focus on healing and rebuilding your lives.

There is not an unlimited amount of time to bring a wrongful death claim. That is because a two-year statute of limitations is generally applicable to these matters per the California Code of Civil Procedure Section 335.1. Evidence that is crucial for proving the case may be lost or destroyed over time. That is why it is crucial to retain legal counsel immediately after a fatal pedestrian accident occurs. Stories can change, and the at-fault party may dispute liability for the incident. A family facing such a situation should have an experienced accident attorney on their side who can work with expert witnesses to determine how the incident occurred and properly establish fault.
