What Types of Losses are Recoverable in a Wrongful Death Claim?
Given that a family loses so much when a loved one is lost in an accident, the damages are often high in wrongful death claims. Economic damages reflect the financial losses survivors have experienced because of the sudden loss of a close relative, such as lost financial support and benefits. It may also consider direct expenses like final resting costs and medical bills (end-of-life treatment expenses are generally recoverable through a survival action).
When a close relative is lost in an accident caused by negligence, surviving family members are deprived of the relationship that the decedent brought to their lives. While it may be challenging to place a price on this, survivors should be compensated for such intangible harm. Fortunately, that is possible through non-economic damages. Survivors may seek compensation for mental anguish from the death of a loved one and the loss of care, companionship, and protection that the deceased provided.
If the at-fault party’s conduct leading up to the fatal incident was particularly egregious, like excessive speeding, surviving family members may seek punitive damages. Survivors may seek such damages in an attempt to punish the other side for their egregious actions and to make an example out of them that the community will not tolerate such behavior.
