What is Involved in the Wrongful Death Claims Process?

The loss of a family member is one of the most painful and trying experiences in life. If a close relative passed away because of a pedestrian accident they did not cause, it may be even more challenging to come to terms with. California law recognizes the hardship that surviving family members may experience following the death of a loved one caused by negligence and provides survivors a way to hold the at-fault party accountable. The process involves bringing a wrongful death claim against the party or entity responsible for the fatal incident. These cases allow the family of the decedent to claim financial compensation for economic and non-economic damages resulting from the loss.

Fatal pedestrian accident cases, like others, are subject to a statute of limitations. The time limit for bringing a wrongful death lawsuit is generally two years from the date of the fatal incident, as outlined in the California Code of Civil Procedure Section 335.1. Damages in these cases are intended to compensate a family for the financial and intangible harms they have experienced because of losing their loved one. These may include costs of medical treatment if the decedent did not pass away immediately and received care for their final injuries, loss of financial support the decedent would have provided to the family, mental anguish from the unexpected death, loss of companionship, and more.

Retaining legal counsel to handle all aspects of a wrongful death case may make all the difference. It may allow you the time to grieve and be with your family in addition to not going through the process alone. While no amount of money may undo the pain of losing a loved one or replace the relationship that was lost, holding the at-fault party accountable through a civil case may provide surviving family members with a sense of justice. An experienced Madera wrongful death lawyer may build a strong case on behalf of survivors and protect their rights.
