How Can a Wrongful Death Claim Help Surviving Family Members?

When a loved one has lost their life in an accident due to the negligence of another party or entity, the family of the decedent may have grounds for a wrongful death claim. While no surviving family member would like to think about taking a civil case to court after losing a family member but taking legal action is essential to obtaining the much-needed sense of justice and financial compensation needed to recover and move forward with a more secure future.

There are some situations where the other party may carry insufficient liability coverage to pay for damages from the incident. In some worst-case scenarios, the at-fault party may not have an active auto insurance policy. Under these circumstances, a family of a decedent may seek recourse through their insurance plan if they have uninsured and underinsured motorist coverage (UM and UIM). What is great about UM and UIM coverage is that it may extend protection to an insured member that suffered bodily harm in an accident as a cyclist or pedestrian. If the deceased did not have auto insurance at the time of their passing but lived with a family member who carried UM and UIM coverage, protection may extend to the decedent so long as they were not an excluded member of the insurance policy.

The best way to protect your rights as a surviving family member and protect your close relative’s legacy is to discuss your case with an experienced accident attorney. Unlike the insurance company, a lawyer will be dedicated to holding the at-fault party liable for their actions and helping survivors find solace. However, finding the right attorney to represent you and your family may be challenging when there are many to choose from in Modesto.
