What Surviving Family Members Can Expect From a Wrongful Death Claim

The most challenging experience any family can go through is the loss of someone you love. What can make this situation more painful is if the incident that claimed a loved one’s life was the result of someone else’s negligence. Survivors deserve justice and closure after the loss of a family member in an accident caused by negligence. Attaining this requires bringing a wrongful death action against the negligent party and their insurance company. If the fatal incident was a hit-and-run accident and the suspect driver is not located, surviving family members may have recourse through their loved one’s insurance policy or their own plan if they carry UM/UIM coverage.

The purpose of a wrongful death case is to seek reimbursement for losses the family has experienced because of the unexpected loss of a loved one. Compensation is intended to help defray financial hardship and provide support for mourning surviving family members. Depending on the facts and circumstances of the case, survivors may seek reimbursement for medical bills incurred before the loved one passed away (can be claimed in a survival action), lost past and future expected earnings, funeral service costs, loss of companionship, mental anguish, and more.

Since California laws surrounding wrongful death claims may be difficult to navigate, it is recommended to seek the assistance of a skilled Pacheco wrongful death attorney who can protect your interests and rights throughout the recovery process. Remember that survivors generally have up to two years to file a case in civil court if a settlement is not reached. Therefore, it is essential to get in touch with a top-rated attorney in your area immediately before it is too late to take legal action against the at-fault party.
