How a Wrongful Death Pedestrian Accident Case May Help a Family

After the loss of a close relative in an accident, the family must face new challenges and difficult emotions every day. Wrongful death is the loss of a loved one’s life that has resulted from the negligence of another party or entity. The term may cover a wide array of situations, such as a pedestrian accident caused by a careless driver. There are laws in California in which specify who may have the grounds to bring a wrongful death claim, the types of damages recoverable, and the statute of limitations, the deadline for which must be followed when filing a lawsuit in civil court.

Determining the value of a wrongful death case involves the connection of a dollar figure to the loss of a close relative in an effort to provide survivors in a way that the decedent would have if not for the fatal car accident. There are various factors in which must be considered when coming up with this amount and whether the deceased person has surviving family members who depended on them emotionally and financially. An insurance settlement generally includes end-of-life medical costs, funeral expenses, loss of companionship, and the value of financial support the decedent would have provided for the family if not for the incident in question.

Surviving family members have a limited amount of time within which legal action must be taken. Under the California Code of Civil Procedure Section 335.1, a wrongful death lawsuit must be filed in civil court within two years of the accident date. Since the golden state has many rules and criteria within which must be met when bringing these types of cases, it is essential to retain legal counsel to protect your rights and best interests.
