Things to Know About the Wrongful Death Claims Process

There is no way of undoing the pain of losing a family member. Whether in a motorcycle accident or other type of traffic collision, any unexpected death caused by someone else’s negligence is heartbreaking and devastating, to say the least. Nothing may replace what was lost, but bringing a wrongful death claim may help surviving family members obtain a sense of justice with the knowledge that the other party has been held liable for their loved one’s death.

Compensation through these types of cases may help survivors pay for end-of-life medical costs, fill in the gap left in the loss of future financial support, expenses for funeral and burial services, and other financial losses. It may also consider the intangible aspects of the sudden death, like mental anguish, loss of companionship, and more. Keep in mind that the claims process is not always straightforward as insurance companies may make it challenging for survivors, particularly if liability is disputed for the incident and disagreements over economic and non-economic damages.

It is also essential to consider the amount of time in which has passed since the date of the fatal motorcycle accident that claimed a loved one’s life. In California, families generally have two years in which to file a lawsuit in court if a settlement is not reached with the insurance company within that time. Under the California Code of Civil Procedure Section 377.60, the spouse, domestic partner, or children of the deceased have priority when it comes to filing these types of cases. If these individuals are nonexistent, then other relatives may be eligible to file. An experienced attorney may determine whether you have grounds to bring a suit.
