What Survivors Should Know About Wrongful Death Claims

Losing a loved one in a motorcycle crash is devastating, particularly if it was the result of another party’s negligence. While no amount of money can ever make things right for surviving family members, filing a wrongful death claim against the other side may help provide a sense of justice, knowing that they have been held accountable for their actions. The types of losses recoverable in this type of claim will depend on the facts and circumstances of the case, in addition to the relationship of the decedent to the family. Survivors who meet the criterion of the California Code of Civil Procedure Section 377.60 may be entitled to the recovery of funeral and burial costs, loss of future earnings, mental anguish, loss of companionship and love, and more.

Surviving family members must know that there is a limited amount of time to take legal action against the party responsible for the death of their loved one. In California, there is a two-year statute of limitations on filing a wrongful death claim. This means that a lawsuit must be filed in court within two years of the fatal crash date. It is essential to note that various factors may influence the duration of the statute of limitations. For instance, if the decedent lost their life in an accident involving a vehicle owned by a government entity or a road defect contributed to the incident, survivors have 180 days to file a notice of claim with the public agency. Failure to meet the filing deadline may result in the dismissal of the case.

To bring a successful case forward, it must be established that the close relative’s death was the direct result of negligence by the other party. This may be accomplished through expert testimony, eyewitness testimony, and physical evidence. In cases where liability is clear, that does not necessarily mean that the insurance company will always do what is right and fairly compensate a family for what they have gone through. The unfortunate reality is that insurers are known for finding ways to get out of paying fair compensation. That is why it is essential to hire an Oakley motorcycle accident attorney to protect your best interests. The video below contains information on how to select a top accident attorney in your area.
