What is Involved in a Wrongful Death Case?

Few situations in life are as painful and traumatic as the loss of someone you love. When a close relative loses their life, it may throw the lives of survivors into disarray. The emotional hardship from the loss may be overwhelming to cope with. Unfortunately, surviving family members are often met with financial challenges following the unexpected incident. Costs of end-of-life treatment for final injuries, expenses for funeral and burial services, and loss of future financial support may further complicate matters for survivors while they are grieving their loss. While nothing may ever make things right again, families affected by such devastating events may work with an experienced Concord wrongful death lawyer to seek financial compensation if their loss was the result of another party’s negligent actions.

Determining whether a loss of life is wrongful death may be challenging as not all fatalities resulting from motorcycle accidents are deemed wrongful deaths. The family of the decedent may seek damages from the at-fault party whose act was intentional, reckless, or negligent. This is by the California Code of Civil Procedure Section 377.60. Survivors who are eligible to bring such cases forward under this section include the spouse, domestic partner, or children. If such relationships are non-existent, then the decedent’s putative spouse, stepchildren, parents, or children of the putative spouse may be eligible for filing.

Every lawsuit must abide by what is referred to as a statute of limitations. This is the amount of time that is permitted to file a case in court. Under the California Code of Civil Procedure Section 335.1, surviving family members have up to two years from the date of loss to file a lawsuit. Failure to comply with the statute of limitations applicable to the case may result in its dismissal by the court. Remember that each fatal motorcycle accident case is different and may be subject to varying time limits. For instance, the deadline may be reduced to 180 days if the case names a public agency as a defendant. Refer to the California Government Code Section 911.2 for more information. That is why it is a good idea to hire a top Concord wrongful death attorney immediately to protect your rights and interests.
