Can You File a Wrongful Death Case for a Fatal Crash?

A fatality may be deemed wrongful death when the individual or entity responsible for the incident is reckless or negligent. Wrongful death cases may arise from traffic accidents, including those involving motorcyclists, and other circumstances. To establish negligence in these matters, there must be clear and compelling evidence. An experienced lawyer can help survivors by collecting all available evidence in their case. This may include video footage, pictures, medical records, statements from eyewitnesses, expert testimonies, police reports, and more.

Not just any individual who knew or loved the decedent is eligible to bring a wrongful death claim in California. Those who meet the criteria set forth in CCP 377.60 may be eligible for filing. Family members with priority include the deceased person’s surviving domestic partner, spouse, or children. Specific exceptions may be applicable based on the circumstances of the matter. In most cases, eligible family members may seek reimbursement for non-economic and economic damages. This may include funeral costs, mental anguish, loss of companionship, loss of earnings, and other relevant losses.

Under CCP 335.1, claimants have a maximum of two years for filing. This means that surviving family members must file before the deadline if the case has not yet settled within that time frame. There are specific exceptions applicable to the statute of limitations in these cases.
