What is Involved in the Wrongful Death Claims Process?

The loss of a family member in a motorcycle collision is a devastating event. It may become more agonizing when it has been learned that the loss was due to the negligence or recklessness of another party or entity. The family of the decedent may have grounds for a wrongful death action against the other side under these circumstances. Priority for filing these claims is generally granted to the children, domestic partner, or spouse of the deceased, according to CCP 377.60. Other relatives may be eligible for filing. This will be based on the facts and circumstances of the matter.

Unfortunately, no amount of compensation from a wrongful death action can undo the pain and devastation that comes with losing a loved one. As the surviving family member of a lost loved one, you owe it to yourself and your family to hold the other side financially accountable for your loss in a civil case. Seeking compensation for economic and non-economic damages from the negligent party or entity may provide the sense of closure and justice your family needs. Compensation may include funeral costs, lost expected earnings, loss of inheritance, loss of companionship, mental anguish, and more.

The statute of limitations puts a deadline on the amount of time within which a case must be filed in civil court. According to CCP 335.1, lawsuits for wrongful death must be filed no later than two years from the date of loss. Please note that specific exceptions may apply. For instance, if unsafe roadway design played a role in the incident, a government entity may be held liable for the road defect in question. A notice of claim against a public agency is subject to a six-month time limit. Therefore, it is essential that survivors discuss their case in detail with an experienced California wrongful death attorney right away.
