What is a Wrongful Death Claim?

The goal of a wrongful death claim is to recover the financial compensation needed to make surviving family members whole again. As a result, it is essential to conduct an evaluation of the full impact of a loved one’s wrongful death on their family. The core of the matter is that a life was lost prematurely due to someone else’s negligence and that surviving family members sustained unimaginable losses. An experienced California wrongful death attorney can help survivors obtain justice, determine the extent of their losses, and seek maximum financial recovery from negligent parties. Importance of Having an Attorney After a Fatal Accident

When a motor vehicle collision or another type of accident has claimed a loved one’s life, it is essential that survivors retain legal counsel immediately. While any family member may discuss their case with an attorney, only specific survivors are eligible for filing. According to CCP 377.60, those with priority generally include the children, domestic partner, or spouse. Conversely, some exceptions may apply if these relationships with the deceased do not exist. For instance, a parent, stepchild, or putative spouse who depended on the decedent for financial support may have grounds for a claim for damages.

Once a lawyer is retained, the attorney will conduct an independent investigation into the fatal incident to determine causation and liability, an assessment of damages, and make a claim against the insurer and at-fault party. From there, all parties proceed with settlement negotiations. If a settlement is not reached with the other side, a California wrongful death attorney will file a lawsuit in civil court. What generally follows filing suit includes continuing or resuming settlement negotiations, preparing for trial, and presenting the case in civil court if necessary.
