What is a Wrongful Death Claim?

Enduring the loss of a close relative can be painful, particularly if the loss results from someone else’s negligence. In such situations, survivors may have a wrongful death claim for damages and hold the other side accountable for their wrongdoing. These claims are generally brought against the at-fault party and their insurance company. Eligible surviving family members may seek reimbursement for loss of earnings, mental anguish, loss of companionship, funeral expenses, among others. However, strict rules are in place for these cases, including eligibility, deadlines, and more.

The statute of limitations is two years from the date of the fatal accident, per CCP 335.1. However, the deadline may be changed by various factors. For instance, if a government vehicle was involved in a fatal motorcycle accident and named a defendant, the statute of limitations is 180 days from the date of loss. Refer to the California Government Code Section 911.2 for more information. Failure to file the case in court to protect the statute of limitations may result in the dismissal of the claim and the loss of the right to seek damages from the at-fault party.
