What is a Wrongful Death Case?

Wrongful death is used to reference a loss of life that has occurred because of an incident caused by someone else’s negligence. No matter the cause, it generally results in unprecedented intangible losses and financial costs for surviving family members. If a family has lost a loved one in a motorcycle accident caused by a negligent driver, they may have the right to seek damages to compensate them for the harm they have endured. This may be accomplished by bringing a wrongful death action against the party responsible for the fatal motorcycle crash and their insurance carrier.

Some of the losses that may be recovered in a wrongful death case may include medical expenses, funeral costs, loss of the decedent’s expected wages, loss of support, mental anguish, and other damages. There are factors that may have an influence on these cases, such as the deceased’s age, education, income, health, degree of survivors’ dependence on them, and more. Aside from such losses, a Merced wrongful death attorney may be able to seek punitive damages if the other side’s actions were egregious. In the case of a fatal motorcycle accident, this may include DUI or excessive speeding.

Who Can File a Wrongful Death Case in California?

Not all relatives can bring a wrongful death claim against a negligent party. Under the California Code of Civil Procedure Section 377.60, the right to bring such cases forward is limited to the surviving spouse, domestic partner, or children. If such relationships do not exist, other relatives may be eligible to bring a claim forward.
