Wrongful Death Compensation in a Fatal Motorcycle Accident Case

A wrongful death claim may exist in situations where an individual has lost their life because of the negligence of another party or entity. Such cases may involve all types of fatal motor vehicle collisions, from car wrecks to motorcycle accidents. People, entities, and public agencies may be held liable for wrongful death, depending upon the facts and circumstances of the case. Under the California Code of Civil Procedure Section 377.60, spouses, domestic partners, or children may bring a claim for damages. This may include financial and intangible losses, such as medical costs, funeral expenses, mental anguish, projected earnings based on the decedent’s life expectancy, household contributions, and more.

A skilled Modesto wrongful death lawyer will work closely with survivors to understand the decedent’s role and how it influenced their daily routines now and into the future. A lawyer may also work with investigators to determine whether another party was involved in a motorcycle accident, such as a hit and run driver or a government entity for an unsafe road condition. In addition, an attorney may consult expert witnesses to prove the true extent of losses incurred to bring the point home to the insurer or a jury that the family has suffered immense damages.
