Losing a Loved One to Wrongful Death

Some things in life are irreplaceable. If your loved one was taken away from your family due to a motorcycle accident caused by someone else’s negligence, the last thing your family may consider is a wrongful death lawsuit during this difficult time. Understandably, the legal system may not replace what your family has lost or undo the pain that has been caused. However, there may be financial concerns related to the loss that should be addressed immediately. A Stockton personal injury attorney who is experienced in handling wrongful death claims can protect your family in your time of grief and ensure you all receive full and fair compensation for your tragic loss. This way, your family can receive the justice and sense of closure you all deserve for the other party’s wrongdoing.

What Types of Damages are Awarded in a Wrongful Death Lawsuit?

Under California law, damages in a wrongful death claim are designed to compensate the family of the decedent for the immense harm they have experienced. While each wrongful death case is unique, survivors are generally entitled to recovery of the following damages:

  • Any direct expenses incurred, such as the end of life medical care and funeral services.
  • Financial losses including lost future earnings, benefits, and pension
  • The care, companionship, and protection that the decedent would have provided to the family if not for the wrongful death truck accident
  • Punitive damages for the egregious conduct of the individual or entity that caused the loved one’s wrongful death (e.g., excessive speeding, DUI, etc.)

The value of economic and non-economic damages in a wrongful death case is dependent on many factors. These include the age of the decedent and their health, education, occupation, income history, and future earning potential. Since insurance companies often resort to defense tactics to downplay the value of a wrongful death claim or deny it in its entirety, it is essential to work with an experienced attorney.
