What is Wrongful Death?

It is painful and devastating to lose someone you love. As a surviving family member, it is helpful to know that you may have grounds for a wrongful death action if your loss resulted from someone else’s negligence. These cases can provide your family with the answers you need to your questions and help provide a sense of closure once the other side has been held accountable for the harm and damages you all have suffered.

How Can a Wrongful Death Claim Help Survivors?

The value of a wrongful death case depends on the facts and circumstances involved. This includes the decedent’s life and the impact of their death on surviving family members. Other factors considered in these matters include the deceased’s age, occupation, education, overall health, financial contributions to the household, and more. Recoverable damages may include mental anguish, loss of companionship, lost inheritance, funeral costs, loss of earnings, medical expenses, loss of benefits like health insurance and pension, and other losses.

In California, the deceased’s family has two years from the time of loss to file a lawsuit against the liable parties in civil court. Children, domestic partners, and spouses are granted priority when filing a wrongful death case. This is by CCP 377.60. If the decedent did not leave immediate family members behind, other relatives may be eligible for filing.
