Loss of a Loved One
Life is challenging after a loved one loses their life. It may be painful and overwhelming, especially when it occurred because of a tragic and preventable accident. Even when the frustration and anger have subsided, surviving family members may have the need to hold the at-fault party accountable for their actions. This may be accomplished through a wrongful death claim brought against the negligent party and their insurance company. While compensation may not undo the pain or bring a loved one back, it may help survivors in moving forward and obtaining a sense of justice during this difficult time.
Wrongful death cases for pedestrian accidents may be challenging, particularly if they occurred because of a hit and run. Under these circumstances, families may bring claims under their loved one’s uninsured motorist (UM) coverage or under their policy so long as their loved one was not listed as an excluded member. While UM coverage may provide some assistance, it may also create stressful situations when insurers try to get out of paying fair compensation to survivors. The most effective and efficient way to protect your rights as a surviving family member is to retain legal counsel.
The role of an experienced Stockton wrongful death lawyer is not only to bring a case against an at-fault party. It is to provide support to surviving family members and guide them through the legal process. An experienced attorney will have the skills and resources to conduct an independent investigation of a fatal accident. A lawyer may also call on expert witnesses to provide testimony or opinions in support of a wrongful death claim and its identified value. Families who seek legal representation may rest assured knowing their case is in good hands.
