Why is it Important to Bring a Wrongful Death Claim?

When a family has lost a loved one in a pedestrian accident, they are often left with unimaginable grief and immeasurable losses. If the incident was the result of a hit-and-run driver, it may often make matters worse for surviving family members attempting to make ends meet, all while planning final resting arrangements. California law recognizes such losses and provides survivors a way to hold at-fault parties liable for their actions through a wrongful death claim. The primary focus of wrongful death cases is to make surviving family members whole again in the form of financial compensation.

There are two types of recoverable losses in a wrongful death case: economic and non-economic damages. The former considers the financial losses that survivors have suffered, whereas the latter is a reflection of intangible harms they have endured. This may include medical expenses, costs of funeral arrangements, loss of earnings and future financial support, loss of companionship, mental anguish, and more. The family may also seek punitive damages from the at-fault party in an effort to punish them for their egregious actions and to prevent similar tragedies from happening to others in the community. Punitive damages are not always available in all cases and are generally awarded by the court.

In cases where a hit-and-run driver is involved, the family may have recourse through their deceased relative’s insurance policy or their own if they have uninsured and underinsured motorist (UM and UIM). The UM portion of the protection may come into play to cover damages up to the limits of the policy. In the latter circumstance, they may be able to bring a claim under their policy so long as the decedent was a member of their household and was not excluded from their insurance plan. Keep in mind that clear and compelling evidence must be presented to prove that the decedent was involved in a hit-and-run pedestrian accident and succumbed to their injuries as a result. First-party insurance claims are also not always straightforward, as insurers may not always be willing to make things right for surviving family members by fairly compensating them for the undue harm they have suffered. That is why it is essential to retain legal counsel to protect your rights and interests.
