What is a Wrongful Death Claim?

The unforeseen and sudden passing of a close relative is always emotionally challenging for the family left behind. However, when the loss of life was entirely preventable had the other party exercised due care, surviving family members may experience anger and frustration in addition to grief. A sudden loss may leave survivors dealing with emotional anguish on top of financial hardships. Unlike injuries from an accident that can potentially heal with appropriate medical care over time, the loss of life is irreversible and has lasting consequences for the decedent’s family.

California law recognizes the devastating reality of losing a loved one and has established specific processes for surviving family members to hold the at-fault party accountable and obtain financial compensation. This serves to alleviate the emotional and financial impact of losing a close relative. Common damages recoverable in these matters include funeral and burial costs, loss of companionship, mental anguish, loss of financial support, and medical bills (via survival action), just to name a few. Furthermore, wrongful death cases are generally subject to a two-year deadline from the date of loss.
