What is Involved in the Wrongful Death Claims Process?

Liability for a wrongful death car accident is expressed in financial recovery. This may help hold the at-fault party accountable and provide survivors a sense of justice. Eligible surviving family members may be compensated for medical bills, funeral service costs, lost future financial support, and loss of benefits. Compensation may be awarded for the decedent’s companionship, care, and protection that they provided to the family. Survivors may also seek reimbursement for mental anguish. If it is found that the incident occurred because of egregious conduct, like DUI or excessive speeding, punitive damages may be awarded at the court’s discretion.

A wrongful death claim must be filed by the decedent’s surviving family members. Per CCP 377.60, specific survivors have grounds to bring such cases forward. This includes the deceased’s children, domestic partner, or spouse. If these relationships are non-existent, other relatives may seek damages in California. This may include the decedent’s stepchildren, parents, putative spouse, and other family members who depended on them for financial support.

In the event of a fatal incident, California law states that the family has up to two years to file a lawsuit in civil court. This is by the CCP 335.1. If the lawsuit is not filed within the two-year statute of limitations, the matter will not be heard by the court, and the family may lose the right to seek damages from the other side. These cases are among the most challenging legal matters. If this has happened to your family, you will need an experienced accident attorney to protect your family’s rights and best interests.
