Details on the Fatal DUI Car Collision on Highway 49

An investigation by CHP traffic officers determined that the Ford SUV was headed southbound on SR-49, traveling toward Angels Camp. The Ford pickup truck was traveling northbound on State Route 49, heading out of the Angels Camp area. The Ford F-150 driver allegedly veered onto the right shoulder of the roadway and lost control of the vehicle. The Ford pickup truck driver then traveled into the southbound lane and struck the front of the Ford SUV.

The impact of the collision caused the Ford SUV to veer off the west side of Highway 49, overturn, and come to rest in the southbound traffic lane. There were five parties in the Ford SUV at the time of the crash. The driver was a 65-year-old Sonora with four passengers, including his wife, a 52-year-old Sonora woman. The three remaining passengers were identified as their children, including a 13-year-old daughter, a 13-year-old son, and an 11-year-old son.

The husband, wife, and two sons were transported to Memorial Medical Center in Modesto and UC Davis Medical Center for treatment of serious injuries. The 13-year-old girl was taken to Mark Twain Hospital, where she succumbed to her injuries, authorities said. The Ford F-150 driver and her 17-year-old passenger were both treated for moderate injuries at the hospital. The Ford pickup truck driver was later arrested for suspicion of DUI and DUI causing bodily injury. Additional details were unavailable.

How a Wrongful Death Claim Can Help Surviving Family Members

Learning that a motor vehicle collision was the cause of a loved one’s demise is a traumatic and life-changing experience unlike any other. If the traffic crash was the result of another party or entity’s careless or negligent actions, it may make the ordeal even more challenging to move forward from. Between grief and the family’s affairs after the unexpected loss of a close relative, taking legal action may be the least of a family’s concerns during this trying time. However, a wrongful death claim may provide surviving family members with a sense of justice and closure by holding the other side financially accountable for the resulting losses.

Economic and non-economic damages are recoverable in wrongful death cases. These may include costs of funeral and burial services in memory of a lost loved one, bills for medical treatment the deceased received before they succumbed to crash-related injuries (recoverable via survival action), loss of companionship, mental anguish, and other losses associated with the wrongful death of a close relative. When the car crash was the result of a drunk driver, survivors may also seek punitive damages from the at-fault party for their egregious conduct. There must be clear evidence proving DUI was a contributing factor to the incident. Punitive damages are intended to prevent similar behavior from them and others in the future.
