Seeking Justice and Compensation in a Wrongful Death Car Accident Case

Cases involving wrongful death are generally based on the premise that the recklessness or negligence of another party led to the tragic demise of a loved one. These cases may encompass various types of accidents, including motor vehicle collisions and more. It is essential for surviving family members to know that an experienced attorney can build and support a case if they have experienced the death of a close relative due to someone else’s careless or negligent actions. A knowledgeable lawyer can provide more information and answer questions in a free case review.

Filing a wrongful death claim in California is subject to specific criteria. The surviving spouse, domestic partner, or children of the deceased person are entitled to filing priority. This is outlined in CCP 377.60. If the decedent does not have a surviving spouse, child, or domestic partner, other family members may have grounds for a claim for damages. An experienced and knowledgeable wrongful death attorney in California can help surviving family members determine their eligibility in their potential case in a free consultation.

The outcome of most cases is often influenced by the strength and relevance of available and admissible evidence. Supporting information will include police reports, video surveillance footage, and the credibility of witnesses. It is not uncommon for the opposing party and insurers to shift liability and claim that the decedent caused or contributed to the fatal incident in some way. The right lawyer will have the experience, skills, and resources to counter such arguments, protect surviving family members, and build the strongest case possible against unfair allegations.

Who Can Be Held Liable for a Fatal Car Crash?

The motorist who caused the traffic collision is generally responsible for economic and non-economic damages. This is typically through the insurer representing the negligent driver. In wrongful death claims, liability may lie with more than one party. This may include the vehicle manufacturer if faulty parts or equipment caused or contributed to the incident. A government entity may also be held liable if unsafe roadway conditions played a role in a crash. Remember that the two-year deadline for accident cases is shortened to six months if a public entity is named a defendant.
