Losing a Loved One in a Fatal Car Accident

The loss of a loved one is devastating. Knowing that the death was caused by someone else’s carelessness may make the grieving process more challenging to bear. Surviving family members deserve justice and closure so they can start recovering from their loss. Survivors can bring a wrongful death action as a way of holding the at-fault party financially accountable for their loved one’s death.

A wrongful death claim is a type of civil case where survivors seek compensation for economic and non-economic damages. These consider the financial hardship and intangible harms the family has suffered because of the fatal car accident. Depending on the unique facts and circumstances of the case, it may be possible for survivors to recover medical expenses, funeral costs, lost future income, and loss of care, companionship, and protection.

By speaking with an experienced Madera wrongful death attorney, you may better understand the legal process and learn about your potential options for recovery. It is essential to keep in mind that California has established a two-year statute of limitations on these cases, which starts from the date of the fatal incident. Building a strong case is a challenging and extensive process, especially when liability and damages are disputed by negligent parties and insurance companies. What You Should Know About Wrongful Death Claims and Insurance Companies

In far too many cases, surviving family members’ rights are lost because they believed that the insurance company was on their side. The unfortunate reality is that insurers will employ claims adjusters, investigators, and defense attorneys to downplay the value of wrongful death claims or outright deny them. This is their way of maximizing their profits.

Under these circumstances, it is best to retain an attorney who has your best interests at heart, unlike the insurance carrier. Your lawyer will work diligently to ensure that the at-fault party is held accountable for your loss. To learn more, contact our law firm today for free, friendly advice on your case.
