Who is Liable for a Single-Vehicle Accident?

Not all solo car crashes are the result of driver error. The at-fault party for a single-vehicle collision may include a government entity or a vehicle manufacturer:

  • Government Entity: The public agency tasked with maintaining the roadway where the crash occurred may be held liable for damages for unsafe road design or insufficient road maintenance. An injured party or surviving family member may have grounds for a claim for damages if the incident was caused by a road defect, like uneven pavement, potholes, poor drainage, etc. Claims against government entities in California are subject to a shorter statute of limitations. A six-month deadline generally applies to notice of claims against public agencies. This is by the California Government Code Section 911.2.
  • Vehicle Manufacturer: An injured party or surviving family member may have grounds for a products liability claim against a vehicle manufacturer if injuries or a loss of life in an accident occurred because of faulty car parts or equipment. In these cases, it must be proven through clear evidence that the car equipment was defective and posed unreasonable dangers to vehicle occupants. It must also be established through compelling evidence that the parts or equipment of the vehicle had insufficient warnings, faulty design, or a manufacturing defect.

An independent investigation by an experienced injury lawyer is necessary to determine the cause of a solo car wreck and who should be held liable for the resulting damages.
