What Types of Damages are Recoverable in Wrongful Death Matters?

The unexpected death of a close relative in an accident is one of the most challenging events that may occur to a family, particularly if it occurred because of someone else’s negligence. Under these circumstances, survivors may bring a wrongful death claim against the other side for resulting economic and non-economic damages. While no amount of money can replace a loved one, it may help support surviving family members in the future. Some of the losses that may be sought in these cases may include lost future financial support, loss of companionship, mental anguish, medical bills, funeral service costs, and more.

Compensation in a wrongful death claim arising from a motor vehicle collision is generally covered by the insurance company representing the at-fault party. In other situations, a first-party insurance claim may be necessary if the other side has insufficient or no liability coverage. This may be accomplished through a claim brought through the decedent’s uninsured and underinsured motorist protection. While we would all hope for the insurance carrier to do what is right and compensate survivors for all the intangible harm and financial hardships they have experienced, that does not necessarily occur in all cases. That is because insurers often downplay the value of cases or deny claims as a way of maximizing profit margins.

The unfortunate reality about the wrongful death claims process is that various challenges may present when dealing with difficult insurers and defense counsel. To protect your future and right to maximum compensation, it is recommended to contact an experienced Antioch wrongful death lawyer. Unlike the other side, your attorney will work to your benefit and have your best interests in mind every step of the way. The right lawyer will have the experience, skills, and resources to build a strong case for maximum financial recovery on your behalf.
