What Families Should Know About Wrongful Death Cases

Wrongful death may occur for a wide array of reasons, most of which are often attributed to negligence. In the case of a fatal car accident, fault may be pinpointed on more than one party. Such crashes may occur because of negligent drivers, faulty vehicle parts and equipment, road defects, and more. It will take an independent investigation by an experienced Stockton wrongful death attorney to determine the exact cause of the deadly incident and the damages incurred.

When claiming compensation for the loss of a loved one in a motor vehicle collision, surviving family members may seek economic and non-economic damages. An accident attorney will assess the value of each loss based on how it has impacted the lives of survivors. After that, the family’s lawyer may seek reimbursement for costs of medical treatment related to the decedent’s final injuries, loss of financial contributions, mental anguish, loss of care and companionship, funeral service costs, and more.

In rare circumstances, a family may be entitled to punitive damages aside from non-economic and economic damages. The sole purpose of punitive damages is to punish the other side for their egregious actions. This helps to make an example out of the negligent party that such behavior will not be tolerated in the community. Punitive damages may be awarded in a fatal car accident case if the incident involved excessive speeding or drunk driving.
